Overview


Our client is among the world's largest and most specialized construction groups, currently making significant strides in the US infrastructure market. Amidst their ongoing expansion in the region, they are proactively investing in strengthening their core commercial management function. In pursuit of this objective, they are actively seeking an accomplished Executive to spearhead the Commercial and Contract Management function for the US market.


This pivotal role involves close collaboration with executive management and the board and will require close collaboration regarding the company's strategic objectives. The focus is on devising a robust contract and commercial management structure that ensures the success of their operations across the Australian business.


With an annual turnover exceeding $12 billion USD and a workforce of over 80,000 employees, they have earned acclaim for their involvement and leadership in some of the world's most iconic civil infrastructure projects.


Your Role


As the business continues to expand across the United States, it is imperative that our client hires best-in-class contract management talent who can protect the business's commercial interests. As Executive Vice President for Contract Management, you will be based in either Virginia or Connecticut and assume responsibility for the following tasks:


  • Support and lead on bid and tender analysis.
  • Develop and implement comprehensive corporate commercial, contract, and risk management guidelines and policies for widespread use across the organization.
  • Create standardized project commercial and contract management plans and procedures.
  • Recruit highly experienced and qualified senior contracts and commercial staff.
  • Conduct training and development programs for commercial teams.
  • Prepare detailed claim particulars, including EOT (Extension of Time), Loss/Expense, Disruption, Acceleration, etc.
  • Offer guidance and direction on claims and dispute management.
  • Develop dispute management protocols and strategies.
  • Manage significant commercial negotiations and disputes from initiation to resolution.
  • Involvement in dispute boards, DABs, and arbitrations.
  • Provide expert advice and direction on various commercial and contractual matters.


Having worked in the international construction environment, you will already be based in the USA or have the necessary work permits and/or visas to work there. Project experience includes tunnels, water, highways, and rail.


You will be fluent in English and a degree-qualified quantity surveyor, engineer, or construction professional with a LLM in construction law and arbitration or equivalent. Those from purely a legal background would not be discounted but at the very minimum they will have a deep experience with construction companies including working on site. Furthermore, you have a stable work history and will be seeking a permanent appointment with the business in USA.
